Generally speaking, it is treatment that is below what is considered the medically accepted standard of care, which causes injury to the patient. If there is no injury, there is no malpractice.Conversely, if the treatment results in injury, or even death, but the care provided is within what would be considered reasonable care in the medical profession, there is no malpractice.
