of
Simon's New York Code of Professional Responsibility Annotated, and Vice
Chair of the NYS Bar Association Committee and Standards of Attorney Conduct,
who stated that a guarantee based on the income from the cases you sign up WILL convert your advertising into referrals, violating ethics rules. A guarantee eliminates
the risk, inherent in advertising, that you may not obtain a client. Elimination
of risk results in your paying for the
cases rather than paying for advertising. A referral exists where a lawyer
pays a fee and either a non-lawyer or another lawyer (without working on the
case) directs a potential client to the lawyer paying the fee. If the
person at the advertising agency offering the guarantee is a lawyer, then s/he
is also violating ethics rules by making a referral. If the person at the
advertising agency offering the guarantee is non-lawyer, then that person and
the advertising agency, by making the referral, is illegally practicing law
without a license, which is a crime. DO NOT accept guarantees without
reviewing the plan with an ethics lawyer, your bar association or court
administration!
What territories are available? Territories are exclusive for your law firm and consist of your entire TV market known as a DMA (Designated Market Area as defined by Nielsen). Where can I use 1-800-HURT-911? Anywhere you want. You can use it in any advertising, whether you obtain the advertising media through us, another agency or on your own, on cards, letterhead, mailings, promotional giveaways such as T shirts, etc.
What costs are involved for law firm advertising?
1) Monthly advertising budget. We can make a recommendation, but you decide how much to spend. Lawyer advertising costs are surprisingly inexpensive, even on daytime broadcast TV, since you only buy local, rather than national airtime. An effective broadcast TV campaign can cost as little as $2,000-$15,000 per month in small markets and $15,000-$40,000 per month in large markets. 2) Monthly vanity phone number license fee for exclusive use of 1-800-HURT-911 for your entire TV market.
3) License fee for 1-800-HURT-911 TV commercials or you can use your own TV commercials. LIMITED TIME OFFER: License FREE use of our 16 TV commercials for as long as you advertise with 1-800-HURT-911 (forever!). Some companies charge as much as $22,500 per year for just six TV commercials.
Are there any other costs involved? Traffic: Whether you
use our TV commercials or those of another company, you will incur a nominal
one-time charge to put your name on the commercials and to ship the
commercials to the TV stations. This fee will vary depending upon the
number of TV stations you advertise on, but usually costs $300-600. Telephone calls: The
actual cost of the telephone calls will be billed directly to you by the
telephone company, at a rate of $.10 per minute with 6 second rounding and 6
second minimum call duration, so you pay almost nothing for hangups, and a $10
per month service charge. Call-center: This is optional, but
recommended. Since overnight
TV advertising works as well as daytime, there is less
competition and TV commercials can cost as little as $2.00, we recommend that you buy overnight spots and use a call center to answer calls
after office hours. You may choose to use any call center or Tele-Direct Call
Centers at a small fee of $0.90/min to
answer your telephone calls, after hours or during the day when your phone is busy, using our exclusive

Calls from cell phones that have an area code and exchange assigned to your
