The following will not apply to injuries from motorcycle accidents since they are excluded from No-Fault coverage. However, most motorcyclists also own a car or could be a passenger in a car accident and this information is important to know in the event you are hurt in a car accident. No-Fault Regulation 68 requires that when a person is injured in a car accident, written notice must be given to the correct No-Fault insurer within 30 days (except in rare circumstances) to obtain benefits. If you fail to provide written notice within 30 days, you may lose the right to obtain payment for your medical treatment, lost income and other benefits. The correct No-Fault insurance company can sometimes be difficult to ascertain and because there is so little time, it's best to have a lawyer determine which is the correct the No-Fault insurance company. Additionally, the information you provide in the written No-Fault application form is critical and you should obtain the assistance of a lawyer to fill out the form.No-Fault coverage is primary to any health insurance policy, which means that No-Fault must pay before your health insurance company is obligated to pay for medical expenses. This means that you cannot decide whether to submit your medical bills to one insurance company or another. Medical bills for injuries sustained in a car accident must first be submitted to the No-Fault insurer. When your No-Fault insurance company denies your claim, you may then submit your medical bills to another insurer. Hospitals and doctors frequently send medical bills to the wrong insurer. I have seen hospitals and doctors mistakenly bill health insurance companies, Medicare and Medicaid for treatment of injuries from a car accident. I have also seen clients who simply decided to submit the bills to the wrong insurer. When this happens, you can become liable for reimbursement of money paid for the medical bills and your personal injury case can be damaged.
