Q: What is broadcast TV? There are 210 broadcast TV markets and 10,000 cable markets in the US. You can see here how many cable TV markets there are in your broadcast market. Obviously, broadcast TV markets are much larger, including many more households and people. Broadcast TV used to be received by roof antennas, but is now mostly received through cable and satellite distributors. The broadcast TV market is basically still the same size, including the same counties as it used to be, because the FCC requires all cable and satellite distributors to carry the broadcast stations. An illustrative example is hamburger meat. You can buy a 1 pound package of hamburger meat at your local supermarket for $4.89 per pound or you can go to Costco and buy hamburger meat for only $2.19 per pound, but they will make you buy 6 pounds for $13.14. Yes! The 1-800-HURT-911 vanity phone number and our slogans were also approved in New York by Professor Roy D. Simon. Neither the word HURT, the number 911, nor the combination of the two as HURT-911 make any unethical claims, such as 1-800-LEADING would make. In fact, an ABA Journal article Vanity Phone Numbers Make Your Advertising Less Forgettable by Laura Hodes says 1-800-HURT-911 is an obvious example of a phone number that spells out a message and shows how some other vanity phone numbers, like ones using the word WIN, violate ethics by making an unsubstantiated claim or creating an unjustified expectation. In Examples of Non-Complying Ads (see 3rd example), The Florida Bar states that the phone number 1-800-TOP-ATTY characterizes the quality of legal services and therefore violates Rule 4-7.2(b)(3).Q: Are 1-800-HURT-911 TV commercials ethical? 1-800-HURT-911, Inc. spent a considerable amount of time and money to produce appealing, yet ethical TV commercials that bring dignity to the legal profession. 1-800-HURT-911, Inc. exclusively retained Professor Roy D. Simon, author of Simon's New York Code of Professional Responsibility Annotated and Vice Chair of the NYS Bar Association Committee and Standards of Attorney Conduct. Although he is very conservative and against much of the lawyer advertising on TV, he not only approved 1-800-HURT-911 TV commercials for New York, he likes them! While most lawyer TV commercials in New York violate some ethics rule, 1-800-HURT-911 TV commercials do not violate any ethics rules in New York State. 1-800-HURT-911 TV commercials were designed to provide information to the public and appeal to people hurt in an accident, without making claims that states do not like. For example, World Law Direct provides a link stating "TOP INJURY LAWYERS" which points to their lawyer referral page proclaiming "Top personal injury lawyers". World Law Direct states that it is both an international and US legal site. While it may not be a problem in other countries, use of the phrase top lawyers in the US has been said by experts to be unethical. Additionally, we suggest that you carefully examine payment schedules. Some lawyer web sites provide a simple directory with a set advertising fee just like the Yellow Pages which is not unethical. HURT-911® does not charge any fee for its attorney directory. Other web sites give referrals, rather than a paid directory listing, which requires very close scrutiny. Web sites such as World Law Direct calls its program their "Lawyers Affiliate Program". Depending upon how they charge, this may be ethical or not.

For each additional TV station, there a one-time charge of only $50 ($30 for a tape plus $20 shipping). The total fee will vary depending upon the number of 1-800-HURT-911 TV commercials you decide to use and the number of TV stations you advertise on, but is usually a one-time cost of only $200 to $600.
4) Telephone calls: While some lawyer advertising agencies will charge you as much as $.75 per minute, we do not markup the telephone billing. In the study, nine companies (Coors, Colgate Total, Pringles, Coca-Cola
Classic, Clorox bleach, Bud Light, Pampers, Mach 3/Turbo, and Aquafina) with
new advertising campaigns (probably for new product lines) on TV, all received
twice the return on investment after long-term advertising when compared to
the return on investment after short-term advertising.
Some lawyers mistakenly choose to advertise on cable TV because it seems much less
expensive. While the cost of a TV commercial on cable TV is very cheap,
the cost per call can be as much as four to eight times more expensive than on
broadcast TV. Cable TV should only be considered by law firms already
spending a large amount on broadcast TV and billboards or law firms which

agencies and bad advertising agencies. Additionally, although advertising
agencies usually charge a 15% commission, your actual cost can vary
substantially among advertising agencies.
